Disney+ Gift Card United Kingdom Terms and Conditions

The following agreement (the “Agreement”) describes the general terms and conditions that apply to the use of Disney+ Gift Cards, as described herein (the “Card(s)”).

This Agreement is between you (“You”) and The Walt Disney Company (Benelux) BV of Asterweg 15S, 1031 HL Amsterdam, Netherlands. For UK residents, this Agreement is between You and The Walt Disney Company Ltd, of 3 Queen Caroline Street, Hammersmith, London, UK, W6 9PE.

By purchasing, accepting or using the Card, you agree to be bound by this Agreement.

1. About the Cards. The Card contains a code, which upon activation may be used to purchase eligible Disney+ subscriptions (the “Subscription”). Cards are redeemable only in the case of eligible Subscriptions purchased directly from Disney+ on disneyplus.com in your country of residence (excluding Extra Member or other ancillary services), unless the Card specifies otherwise. Depending on the applicable Card program in your territory, Cards may be purchased in fixed denominations, or for a value chosen by you when you purchase the Card (subject to minimum and maximum limits as set out on the Card).

2. Purchasing the Cards. To purchase a Card, you must be over 18. The Card cannot be combined with other offers, coupons, discounts, or promotions, unless otherwise specified on the Card.

3. Activation. A Card is not valid for use until it has been validly activated following the applicable activation process. Follow activation instructions carefully.

4. Disney+ Service. Use of Disney+ is subject to compliance with the Disney+ Subscriber Agreement (“Subscriber Agreement”) and acknowledgement of the Disney Privacy Policy. In the event of any inconsistency between the Subscriber Agreement and this Agreement, the terms of this Agreement shall prevail.

5. Card Redemption. To redeem the Card: 1. Activate with cashier; 2. Go to DisneyPlus.com/gift; 3. Scratch off below; 4. Log in or create a Disney+ account

To be eligible to redeem a Card, you must be over 18, have a valid email address, be a new, returning or existing subscriber, and you must accept the applicable Disney+ Subscriber Agreement (disneyplus.com/legal/user-agreement), privacy policy, and terms and conditions. To redeem the Card, you must be resident in a territory offering Disney+ which is participating in the Disney+ Gift Card scheme.

For Italy residents, to purchase and redeem the card with Disney+ made available in Italy, you must be resident in Italy.

For UK residents, to purchase and redeem the card with Disney+ made available in UK, you must be resident in UK.

A new eligible Subscriber to Disney+ may redeem a Gift Card by visiting disneyplus.com/gift.

An existing eligible Subscriber to Disney+ may redeem a Card by logging on to their Disney+ account and adding the Card as a method of payment. Extra member accounts are not eligible for gift card redemption.

You must follow the redemption instructions as advised on the Card and as part of the redemption flow. Compatible software, hardware and internet access are required to redeem and use the code.

6. Card balances and Cancellation. Upon redemption of a Card, you will receive a gift card credit (a “Gift Card Credit”) equal to the value of the Card. Your Card will be fully redeemed immediately upon conversion to Gift Card Credit. The Gift Card Credit may only be applied toward a Subscription of Disney+ if the amount of the Gift Card Credit equals or exceeds the then-current retail price of such Disney+ Service at the time of redemption. At the beginning of each Subscription billing term (the first date of such billing term, the “Billing Date”), the Gift Card Credit will be debited the price of the Subscription as of the Billing Date, in addition to any applicable taxes and fees, until the Gift Card Credit is fully exhausted. In the event that the remaining Gift Card Credit on the Billing Date is insufficient to cover the cost of the full subscription billing term, you will receive access to Disney+ for a pro rata portion of the subscription billing term based on the price of the Subscription on the Billing Date. Payment pause functionality is not applicable towards Gift Card Credit during a Card redemption period. Once the Gift Card Credit has been reduced to zero, you will lose access to the Subscription and your Subscription will be terminated, unless you provide or have previously provided a payment method (such as credit or bank card) (“Payment Method”), or redeem another Card. If provided, your Payment Method will be charged the then-current price of the Subscription on a recurring basis for continued access to the Subscription (including applicable taxes and fees) after the Gift Card Credit is fully exhausted. If you have elected to cancel the Subscription before the Gift Card Credit is fully exhausted, such cancellation shall become effective when the Gift Card Credit is fully exhausted and your Payment Method will not be charged for such Subscription. You may change your Payment Method information or cancel your Subscription by logging into Disney+. For other information about cancellation of your Subscription, please see your Subscriber Agreement.

7. Single use; No refunds, returns or cash redemptions; Not Combinable with Other Offers. The redemption code on a Card is for a one-time use only. The Card is non-refundable, except if and as required by applicable law. Without prejudice to local laws, a Card cannot be redeemed for cash, merchandise or be used to refund payments for a current Subscription. Gift Card Credits cannot be transferred back to the Card redeemed for such Gift Card Credits. The Card may be used to purchase eligible Disney+ Subscriptions, but Cards cannot be combined with other offers, coupons, discounts, or promotions, unless otherwise stated in the same. You acknowledge that when you redeem the Card and sign up to the Disney+ Service you agree, upon express consent, that if you start downloading or accessing any digital content of Disney+ you lose your right to withdraw and receive a refund from the Disney+ Service

8. Right of Withdrawal. If you purchased the Card online from disneyplusgift.com, you have a statutory right to withdraw by cancelling your order for a full refund from Disney without giving any reason. The right shall apply for a period of fourteen (14) days, beginning on the date of the purchase. However, you acknowledge that when you redeem the Card and sign up to the Disney+ Service you agree, upon express consent, to the immediate download of digital content and that if you access any digital content, you will lose your right to withdraw. To exercise your right of withdrawal, you must notify: Disney+ Customer Services, The Walt Disney Company (Benelux) BV, of Asterweg 15S, 1031 HL Amsterdam, Netherlands, or for UK Gift Card purchasers, The Walt Disney Company Ltd of 3 Queen Caroline Street, Hammersmith, London, UK, W6 9PE, by e-mail: help@disneyplus.com with a clear statement (e.g. letter or email) of your decision to withdraw. Reimbursement shall be via the same means of payment as you used for the initial Gift Card transaction, unless agreed otherwise by the parties. You may use the standard withdrawal form attached in the Annex, which is not mandatory.

9. No Resale. Cards are non-transferable and may not be resold without Disney’s express written authorisation. A Card is not valid and will not be honoured if the Card is obtained from an unauthorised seller or reseller, including through any internet auction site.

10. Fraud. Disney reserves the right to refuse to honour a Card if Disney suspects that the Card or code has been obtained fraudulently, by theft, or via unauthorised means.

11. Limitation of Liability. Disney accepts no liability for loss, theft, misuse, or fraudulent use of the Card.

12. Governing Law and Jurisdiction. This Agreement, and any dispute or claim arising out of, or in connection with the Card, is governed by and construed in accordance with the laws of the Netherlands, without prejudice to the mandatory rules that may apply in your country of residence. Any dispute between you and The Walt Disney Company (Benelux) BV or its affiliates, shall be settled by the competent court of your residence or domicile.

For UK residents, this Agreement, and any dispute or claim arising out of, or in connection with the Card, is governed by and construed in accordance with the laws of England and Wales. Any dispute between you and The Walt Disney Company Ltd, or its affiliates shall be settled by the competent Courts of England and Wales.

13. Severance. Notwithstanding anything herein to the contrary, if any part of this Agreement is deemed invalid or inapplicable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal and enforceable. If such provision cannot be so modified or restricted, it shall be removed from this Agreement without affecting the validity, legality or enforceability of the remainder of this Agreement, which shall be fully enforced.

14. Changes to this Agreement. Disney reserves the right to modify, alter, change or amend this Agreement from time to time without advance notice, for any of the following reasons: (i) to change, alter, improve or add to any of our services or gift card programs; (ii) to change the way we structure our services and gift card programs; (iii) to improve the security and operation of our technical infrastructure (for example, to prevent misuse); (iv) where we change our systems for Card activation, use or redemption or distribution; (iv) to change the scope of Card functionality, features and benefits; (v) for any valid legal or regulatory reason; or (vi) to make the terms of this Agreement clearer or easier to understand.

16. The Card issuing company is: The Walt Disney Company (Benelux) BV, of Asterweg 15S, 1031 HL Amsterdam, Netherlands (except in UK, where Cards are issued by The Walt Disney Company Limited, 3 Queen Caroline Street, Hammersmith, London W6 9PE).
